1. About AFAFKA

AFAFKA is an independent small business operated by Viktoriia Kukhar, a sole proprietor (FOP) registered in Ukraine.

AFAFKA designs and sells clothing and accessories for dogs through afafka.com.

References in these Terms to “AFAFKA,” “we,” “us,” or “our” mean the business operated by Viktoriia Kukhar.

2. Acceptance of These Terms

By accessing or using afafka.com, creating an account, placing an order, or using any feature provided through the website, you agree to be bound by these Terms of Use.

If you do not agree to these Terms, you should not use the website or its services.

Our collection and use of personal information is described separately in our Privacy Policy.

3. Eligibility

You must be legally capable of entering into a binding agreement in your jurisdiction to make purchases or create an account with AFAFKA.

If you are under the age of majority where you live, you may use the website only with the involvement and permission of a parent or legal guardian.

4. Your Account

Some AFAFKA features may require you to create an account.

You are responsible for providing accurate information and for keeping your account credentials secure.

You are responsible for activity that occurs through your account, except where the activity results from circumstances for which AFAFKA is legally responsible.

We may suspend or restrict an account where reasonably necessary to protect the website, customers, AFAFKA, or other users from fraud, abuse, unauthorized access, or violations of these Terms.

5. Sign In with Google

AFAFKA may allow you to create an account or sign in using Google or another supported third-party authentication provider.

Your use of a third-party authentication service is also governed by that provider’s own terms and privacy practices.

AFAFKA does not receive your Google password.

6. AFAFKA Club and Dog Profiles

AFAFKA may provide account features that allow you to create profiles for one or more dogs.

You may be able to provide information such as your dog’s name, breed, age, size, measurements, weight, gender, and photos.

You are responsible for ensuring that information you provide is reasonably accurate and that you have the right to upload any photos or other materials submitted through your account.

Dog-profile information is intended to help provide personalized features and improve your shopping experience. It does not replace your responsibility to review individual product measurements, sizing information, and fit recommendations before purchasing.

8. Product Information

We make reasonable efforts to describe and display AFAFKA products accurately.

However, colors and appearance may vary depending on lighting, photography, screen settings, materials, and the handmade nature of certain products.

Handmade items may have small variations between individual pieces. Such minor variations are not necessarily defects and may be part of the character of handmade production.

Product measurements and specifications are provided to help customers select an appropriate item, but minor production tolerances may occur.

9. Sizing and Fit

Dog breeds, body proportions, coat thickness, and individual measurements can vary significantly.

You are responsible for measuring your dog and reviewing the applicable product size information before placing an order.

Our sizing guides and recommendations are intended to assist you, but they cannot guarantee an identical fit for every dog.

10. Prices

Product prices are displayed on the website in the currency shown at the time of purchase.

Prices may change from time to time.

A price change does not affect an order that has already been accepted, except where correction is permitted or required by applicable law.

Shipping charges, taxes, duties, or other applicable amounts may be shown separately during checkout where applicable.

11. Orders

Submitting an order does not necessarily mean that the order has been accepted.

We may review an order before acceptance for reasons such as product availability, payment authorization, suspected fraud, incorrect pricing, shipping limitations, or other legitimate operational reasons.

An order may be declined or cancelled where reasonably necessary, subject to applicable consumer law.

If we cancel an order after payment has been successfully collected, we will arrange an appropriate refund for the cancelled amount.

12. Payment

Payments may be processed by third-party payment processors or financial service providers.

By submitting payment information, you represent that you are authorized to use the payment method provided.

Payment providers may apply their own terms, verification requirements, fraud-prevention procedures, and privacy policies.

13. Shipping and Delivery

AFAFKA may use third-party fulfillment, logistics, postal, and delivery providers.

Some orders may be fulfilled or shipped through service providers located in the United States.

Delivery estimates are estimates rather than guaranteed delivery dates, unless we expressly state otherwise.

Delivery may be affected by circumstances outside AFAFKA’s reasonable control, including carrier delays, weather, customs procedures, incorrect delivery information, or other transportation disruptions.

14. Returns and Exchanges

Returns and exchanges are governed by the policy displayed on our Returns & Exchanges page.

Nothing in these Terms is intended to remove rights that cannot lawfully be waived under applicable consumer protection law.

15. Promotions, Discounts, and Rewards

AFAFKA may occasionally offer promotional codes, discounts, gifts, rewards, contests, club benefits, or other promotional features.

Promotions may have separate eligibility requirements, expiration dates, usage limits, product restrictions, or other conditions.

Unless otherwise stated, promotional offers have no cash value, cannot be exchanged for cash, and may not be combined with other offers where prohibited by the applicable promotion.

AFAFKA may correct or cancel promotions affected by technical errors, fraud, abuse, or obvious mistakes, subject to applicable law.

16. Email Communications

If you subscribe to marketing communications, you may receive AFAFKA product news, promotions, discounts, or other marketing messages.

You can unsubscribe from marketing emails using the unsubscribe link included in those messages.

Transactional communications necessary for your account or orders may still be sent after you unsubscribe from marketing communications.

17. Your Content

You retain ownership of photographs and other original content that you submit to AFAFKA, subject to any rights belonging to others.

By submitting content for an AFAFKA feature, you grant AFAFKA a limited, non-exclusive permission to store, process, reproduce, and use that content as reasonably necessary to provide the feature or service you requested.

For example, if you upload a dog photo for virtual try-on, AFAFKA may process that photo as necessary to generate and display the requested result.

We do not obtain ownership of your original photograph merely because you upload it to your account or an AI feature.

18. AFAFKA Content and Intellectual Property

The AFAFKA website and its original content, including branding, logos, product photographs, graphics, text, designs, website elements, and other materials, may be protected by copyright, trademark, and other intellectual property laws.

Except where expressly permitted, you may not reproduce, distribute, sell, modify, scrape, republish, or commercially exploit AFAFKA content without authorization.

You may use the website for your personal, lawful shopping and account-related purposes.

19. Prohibited Uses

You may not use the website or AFAFKA services to:

• Violate applicable law or the rights of others.
• Attempt to gain unauthorized access to accounts or systems.
• Distribute malicious software or harmful code.
• Interfere with the security or operation of the website.

Third-party services operate under their own terms and policies.

AFAFKA is not responsible for the independent acts or omissions of third parties beyond the extent required by applicable law.

We aim to keep the AFAFKA website available and functioning properly, but uninterrupted availability cannot be guaranteed.

The website or individual features may occasionally be unavailable because of maintenance, updates, technical problems, security measures, third-party service interruptions, or circumstances outside our control.

We may modify, update, replace, or discontinue website features from time to time.

To the extent permitted by applicable law, the website and optional digital features are provided on an “as available” basis.

We do not guarantee that every website feature will always be uninterrupted, error-free, or compatible with every device or browser.

Nothing in these Terms is intended to limit mandatory consumer rights that apply to your purchase.

24. Governing Law

These Terms are governed by the laws of Ukraine, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your place of residence provide rights that cannot lawfully be excluded or restricted.

Nothing in this section is intended to deprive a consumer of protections that apply to them under mandatory law.

We may update these Terms from time to time to reflect changes in our products, services, website features, business practices, or legal requirements.
